1. Terms of Use
1.1. These Terms of Use of the website (hereinafter referred to as the “Terms”) govern the procedure for access to and use of the Lovekitchen.me website (hereinafter referred to as the “Website”).
1.2. The owner and administrator of the Website is Individual Entrepreneur Lukash Olena Oleksandrivna, duly registered in accordance with the legislation of Ukraine, Tax Identification Number (TIN): 3006120889, contact e-mail: lovekitchen.me@gmail.com (hereinafter referred to as the “Website Administration”).
1.3. Any person who accesses the Website, browses its pages, registers, or places an order is deemed to have read these Terms and to have fully and unconditionally accepted them (hereinafter referred to as the “User”). If you do not agree with these Terms, please discontinue use of the Website.
1.4. Relationships related to the purchase of goods or paid services are additionally governed by the Public Offer and the Payment and Refund Policy published on the Website. In the event of any inconsistency, the provisions of the Public Offer shall prevail.
2. Use of Website Materials
2.1. The Website Administration grants the User the right to view the materials published on the Website solely for personal, non-commercial use, provided that all copyright notices and other intellectual property rights notices are preserved.
2.2. Without the prior written consent of the Website Administration, it is prohibited to:

3.1. To access certain features of the Website (including, but not limited to, subscription purchases, commenting, and access to restricted materials), the User may be required to complete a registration process.

10. Governing Law and Dispute Resolution

10.2. Any disputes or disagreements arising between the parties shall, as far as possible, be resolved through negotiations. If no agreement is reached, the dispute shall be subject to consideration by the competent courts at the location of the Website Administration, in accordance with the procedural legislation of Ukraine.

Terms of Sale and Service for the Lovekitchen.me Website
This document constitutes an official Public Offer by Sole Proprietor Lukash Olena Oleksandrivna (hereinafter referred to as the “Seller”) to enter into a contract for the sale of goods and/or the provision of services under the terms and conditions set forth herein.
In accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine, this document is a contract of adhesion. By making a payment for goods or services on the Lovekitchen.me website, the Customer confirms their full and unconditional acceptance of the terms of this Offer.
1. General Provisions
1.1.This Public Offer governs the relationship between the Seller and the Buyer regarding:

the purchase of physical goods (books and other products);
-
the purchase of digital goods (PDF files, recipes, books);
-
payment for and access to paid content (subscriptions, restricted materials).
1.2. The purchase of goods or the subscription to paid content constitutes the Buyer’s full and unconditional acceptance of the terms of this Public Offer, the Privacy Policy, the Terms of Use of the Website, as well as the sections “Payment and Delivery” and “Returns”.
2. Parties to the Agreement

Place of registration: Kyiv, Ukraine.
Buyer: Any legally capable individual who places an order on the Website.
3. Subject of the Agreement
3.1. The Seller undertakes to transfer the goods to the Buyer or provide access to digital content, and the Buyer undertakes to accept and pay for such goods or content.
3.2. Digital content includes, but is not limited to:

electronic books;
-
PDF files;
-
recipes;
-
access to subscriptions and restricted materials.
3.3. Access to digital content shall be deemed provided from the moment it is sent to the Buyer’s e-mail address or when access is granted via a user account or a direct link.
4. Order Placement Procedure
4.1. The Buyer places an order on the Lovekitchen.me website by completing the order form and/or by paying for the goods or subscription through an electronic payment system available on the Website
4.2. The Seller reserves the right to refuse to process an order in the following cases:
-
the goods or services are temporarily unavailable;
-
the Buyer has provided incomplete or inaccurate information;
-
technical errors or system failures have occurred.
5. Price and Payment
5.1. Prices displayed on the Website are indicated in Ukrainian hryvnias (UAH).
5.2. Payment is made exclusively online through the Portmone payment service available on the Website.
5.3. The Seller does not store or process the Buyer’s bank card details.
5.4. Payment shall be deemed completed at the moment the funds are credited to the Seller’s account.
6. Delivery
6.1. Delivery of physical goods is carried out by the Nova Poshta service in accordance with the terms specified in the “Payment and Delivery” section of the Website.
6.2. Delivery costs are borne by the Buyer in accordance with the carrier’s applicable tariffs.
6.3. International delivery is available only upon individual request.
7. Returns and Refunds
7.1. Returns of goods are carried out in accordance with the “Returns” section of the Website.
7.2. Digital content, including but not limited to electronic cookbooks, PDF files, recipes, and paid subscriptions, is considered "used" at the moment access is granted or the file is downloaded. Therefore, digital products are non-refundable and non-exchangeable once the delivery of digital access has occurred.
7.3. Printed publications of proper quality are not subject to return in accordance with Resolution of the Cabinet of Ministers of Ukraine No. 172.
8. Rights and Obligations of the Parties
The Buyer shall be obliged to:
-
provide accurate and complete information when placing an order;
-
make timely payment for the order;
-
inspect the goods upon receipt.
The Seller shall be obliged to:
-
deliver the goods or provide access to digital content in accordance with the terms of this Public Offer;
-
ensure the proper operation of the payment system within the scope of the Seller’s responsibility;
-
provide support regarding issues related to access to digital content.
9. Intellectual Property
9.1. All materials available on the Website, including but not limited to books (both printed and electronic), texts, photographs, PDF files, recipes, and other content, constitute the intellectual property of the Seller.
9.2. Any copying, distribution, or publication of such materials without the prior written consent of the rights holder is strictly prohibited.
10. Confidentiality
10.1. The processing of personal data is carried out in accordance with the Privacy Policy.
11. Dispute Resolution
11.1. Any disputes arising between the parties shall be resolved through negotiations.
11.2. If no agreement is reached, the dispute shall be resolved in court in accordance with the legislation of Ukraine.
12. Term of the Offer
12.1. This Public Offer is valid for an indefinite period of time.
12.2. The Seller reserves the right to amend the terms of this Public Offer without prior notice.
12.3. The current version of the Public Offer is always available on the Lovekitchen.me Website.
Payment and delivery
1. Payment
1.1. Payment for goods and services on Lovekitchen.me is made exclusively online by bank card through the certified payment service Portmone.
1.2. After confirming the order, the User is automatically redirected to the secure payment page of Portmone.com.
1.3. Portmone is certified in accordance with the international PCI DSS standard, which ensures payment security.
1.4. The Website does not store or process Users’ bank card details.
2. Delivery within Ukraine
2.1. Delivery of printed publications and other physical goods is carried out by the Nova Poshta delivery service.
2.2. Orders are shipped within three business days after payment.
2.3. Delivery costs are paid by the Buyer in accordance with the carrier’s applicable tariffs.
2.4. The Buyer is obliged to collect the parcel within the time limits established by the carrier.
2.5. In the event of delayed collection, additional storage fees charged by the carrier shall be borne by the Buyer in accordance with the carrier’s tariffs.
3. Inspection of Goods upon Receipt
3.1. Upon receipt of the goods, the Buyer is obliged to inspect the goods in the presence of a representative of the delivery service, including:
-
integrity of the packaging;
-
absence of mechanical damage;
-
compliance of the contents with the order.
3.2. If any damage is detected, the Buyer must:
-
prepare a damage report (act);
-
record the defects by photo or video;
-
send the materials to: lovekitchen.me@gmail.com.
Without a properly completed damage report, a return or compensation may not be possible.
4. International delivery (upon individual Request)
4.1. International delivery of physical goods is not a standard service of Lovekitchen.me and is not calculated automatically on the Website.
4.2. Upon the Buyer’s request, the Seller may consider the possibility of arranging an individual shipment of goods outside Ukraine.
4.3. The shipping cost and available delivery options shall be communicated to the Buyer after the request has been reviewed.
4.4. All costs related to international delivery shall be borne by the Buyer in accordance with the tariffs of the selected carrier.
4.5. Shipment is carried out within three business days after full payment for the goods and delivery, provided that the Seller has confirmed the possibility of international shipment.

Return
1. Return of Goods of Inadequate Quality
1.1. Goods may be returned if a defect or damage is detected.
1.2. To consider a return request, the Buyer must provide:
-
a completed return request (in any form);
-
photos or videos clearly showing the damage or defect;
-
proof of payment;
-
a document confirming receipt of the parcel;
-
a damage report (except in cases of printing defects in books).
1.3. Return requests are reviewed within three (3) business days.
1.4. Refunds are processed within fourteen (14) calendar days after confirmation of the return.
1.5. Return of goods of inadequate quality is carried out at the Seller’s expense.
1.6. If the required documents are submitted incompletely, the Seller reserves the right to refuse consideration of the return request.
2. Return of Goods of Proper Quality
2.1. The Buyer has the right to return or exchange goods of proper quality within fourteen (14) days from the date of purchase or receipt.
2.2. Goods may be returned only if all of the following conditions are met:
-
the goods have not been used;
-
their original appearance and consumer properties are preserved;
-
the complete set is retained.
2.3. Delivery costs associated with the return of goods of proper quality shall be borne by the Buyer.
3. Return of Printed Publications
3.1. In accordance with Resolution of the Cabinet of Ministers of Ukraine No. 172, printed publications of proper quality are not subject to return or exchange.
3.2. In the event of printing defects (such as missing pages, misprints, inverted pages, or similar defects), the book may be returned:
within fourteen (14) days from the date the defect is discovered;
-
but no later than thirty (30) days from the date of purchase.
3.3. In such cases, a damage report from the delivery service is not required.
4. Return of Digital Content
4.1. Electronic books, PDF files, recipes, and access to paid digital content are not subject to return or exchange.
4.2. If the Buyer has been granted access to the digital content or subscription but is unable to use it due to technical issues on the Buyer’s side, no refund shall be provided.
4.3. Refunds are possible only if the digital file provided by the Seller is defective, does not open, and the Seller is unable to provide a functional replacement.
4.4. Digital content of proper quality that has been successfully delivered or access to which has been granted to the Buyer is not subject to return.
